I. Teijin Pharma Limited Privacy Policy

Teijin Pharma Limited (hereinafter, the "Company") and the Company’s group companies (hereinafter, the "Group Companies") believe that it is our social responsibility to properly handle and protect personal information in all aspects of our corporate activities. The Company and the Group Companies shall comply with laws and regulations relating to the protection of personal information, and strive to live up to the confidence of society based on the following policy, which conforms to the Teijin Group Privacy Policy.

1. Acquisition of Personal Information

We shall acquire personal information by lawful and fair means.

2. Use of Personal Information

We shall specify the purpose of use of the personal information to be acquired, and inform it to the subject of the information. The acquired personal information shall be used for business purposes within the scope of its purpose of use.

3. Security Control of Personal Information

The Company and the Group Companies shall strive to prevent the loss, destruction, falsification or leakage of, or unauthorized access to personal information. As security control measures to achieve this, we shall appoint a person responsible for personal information protection management, and establish an appropriate mechanism to ensure effectiveness of such measures. We shall also raise awareness toward security control through training of officers and employees.

4. Provision of Personal Data to a Third Party

We shall not disclose or provide personal information to any third party without the consent of the subject of the information, except in the following cases. When disclosing or providing the information to a third party, we shall make every effort to ensure that such third party takes measures for protection, including the prevention of improper leakage of personal information.

  1. In the case where the information is provided to a contractor or business partner to the extent necessary for business.
  2. In the case of succession of business under laws and regulations due to merger, company split, transfer of business or other reasons.
  3. In the case where the provision of information is required or permitted by applicable laws and regulations, the information shall be provided to the extent stipulated by such laws and regulations.

5. Disclosure, Correction, etc. of Personal Information

If the subject of the personal information held by the Company requests disclosure or correction of the information, we shall promptly respond to such request in accordance with the spirit of laws and regulations.

6. Public Announcement, Revision, and Improvement of Efforts to Protect Personal Information

We shall publicly announce this Privacy Policy, which addresses the protection of personal information, and externally clarify various procedures, including the method for making inquiries regarding the handling of personal information. We shall also strive to continuously improve and enhance these efforts.

II. Handling of Personal Information by the Company

This section explains the purpose of acquisition and the handling of personal information acquired by the Company and the Group Companies, in accordance with the provisions of the Act on the Protection of Personal Information.

1. The Company’s Basic Stance on Personal Information

We shall respect the spirit of the Act on the Protection of Personal Information, and comply with the Teijin Group Privacy Policy, Teijin Pharma Privacy Policy, Teijin Group Personal Information Protection Rules, Teijin Group Personal Information Protection Guidelines, and Teijin Group Privacy Policy for GDPR.

3. Personal Information Held by the Company and Purpose of Use

The Company and the Group Companies use personal information for the following purposes in the manufacture and sale of pharmaceuticals, the manufacture and sale of home healthcare-related products, and other business activities.

(1) Personal information about physicians, dentists, pharmacists, pharmacies, drug stores, other healthcare professionals, and research institutions related to medical and pharmaceutical sciences

  • Providing, collecting, or communicating information on the proper use of pharmaceuticals, medical devices, and other products and services handled by the Company (hereinafter, "Pharmaceuticals and Medical Devices, etc.")
  • Providing, collecting, or communicating information on the quality, safety, or efficacy of Pharmaceuticals and Medical Devices, etc.
  • Keeping track of delivery destinations of Pharmaceuticals and Medical Devices, etc. or maintaining the contact network
  • Collecting or providing information in the event of a recall of Pharmaceuticals and Medical Devices, etc. or other incidents, or responding to or preparing for such incidents
  • Keeping track of delivery destinations of bio-based products or establishing or enhancing the information network
  • Providing or collecting information related to Pharmaceuticals and Medical devices, etc.
  • Conducting or supporting investigations or research or academic or educational activities, such as seminars or lectures, in the field of medical or pharmaceutical sciences
  • Performing the work incidental to requests for or implementation of clinical studies or post-marketing surveillances of Pharmaceuticals and Medical Devices, etc.
  • Investigating, examining, or responding to the status of development or use, actual usage situation, or users’ needs of Pharmaceuticals and Medical Devices, etc.
  • Authenticating membership of the Internet site for healthcare professionals or contacting members
  • Making a notification or reporting to government agencies or participating organizations
  • Fostering good communication
  • Performing other work incidental to the above-mentioned work

(2) Personal information of patients, etc. obtained in the course of business operation or development in the domain of home healthcare

  • Providing medical examinations, treatment or services, installing, taking back, conducting periodic maintenance checks on, delivering or making an emergency response to medical devices, etc., or performing the work incidental to the above

(3) Personal information about persons belonging to wholesalers or agents of Pharmaceuticals and Medical Devices, etc.

  • Engaging in collaboration to facilitate the efficient promotion of Pharmaceuticals and Medical Devices, etc.
  • Providing, collecting, examining, or communicating information on the quality, safety, or efficacy of Pharmaceuticals and Medical Devices, etc.
  • Engaging in collaboration in responding to a recall of Pharmaceuticals and Medical Devices, etc. or other incidents
  • Investigating or keeping track of delivery destinations, actual usage situation, or users’ needs of Pharmaceuticals and Medical Devices, etc.
  • Fostering good communication
  • Performing other work incidental to the above-mentioned work

(4) Personal information about persons who have contacted the Company’s contact point

  • Understanding, examining, investigating, or responding to inquiries or reports
  • Communicating or providing information to marketing authorization holders, manufacturers, distributors, or healthcare professionals
  • Making a notification to government agencies

(5) Genomic data that make it possible to identify the data subject

  • Conducting research, etc. for achieving efficacy and safety of Pharmaceuticals and Medical devices, etc.

(6) Personal information about applicants for employment

  • Examining and deciding whether to recruit the applicant

(7) Personal information about relevant parties in the neighborhood, voluntary organizations and other stakeholders

  • Implementing communications, consultations, reviews, negotiations, information provision, or distribution or receipt of materials related to or handling external relations
  • Operating collaborative activities and implementing associated communications, consultations, reviews, information provision, or distribution or receipt of materials

(8) Personal information about officers, employees, employees’ families and retired employees

  • Performing labor management such as business communications, attendance management, payment of salaries, reimbursement of expenses, proper arrangement of personnel, personnel evaluation, skill development, welfare benefits or safety and health, or other obligations stipulated in laws and regulations relating to labor, tax, or social welfare
  • Accepting, implementing or managing various procedures stipulated in internal rules
  • Communicating with the health insurance association, corporate pension fund, or other welfare-related organizations or Teijin group companies, sending internal newsletters and other materials, making contact in case of emergency, or making contact or sending materials in social affairs, such as reunion of retired employees

4. Joint Use of Personal Data

Personal data are used jointly with specific parties as follows.

(1) Personal data of healthcare professionals such as physicians, dentists, and pharmacists

    The Company and Group Companies such as Teijin Healthcare Limited shall jointly use with specific companies the personal information in the medical database (MDB) managed and operated by Nihon Ultmark.

      Matters concerning the status of home care that can be used as reference for medical examination or treatment by the attending physician, and the patient's name, postal code, address and telephone number (Please note that the patient's name and contact information are obtained based on a consignment contract with the medical institution.)

(3) Personal data about persons belonging to wholesalers or agents of Pharmaceuticals and Medical Devices, etc.

5. Anonymously Processed Information

The Company may acquire anonymously processed information and utilize it for analysis or investigation, and may provide such information to third parties on an ongoing basis to the extent necessary for business. When providing such information to a third party, the Company shall take necessary actions required by law. The following are the items of information pertaining to individuals included in anonymously processed information to be provided to third parties and the method of provision.

(1) Items of information pertaining to individuals included in anonymously processed information to be provided to third parties

  1. Physical information such as gender, age, date of birth, height, and weight
  2. Information on medical treatment (e.g., information on diseases, treatments/procedures, tests, and hospital admissions/discharges)
  3. Information on health checkups (e.g., date of checkup, data on checkup/medical interview items, questionnaire data on diet, exercise, smoking, etc.)
  4. Information on qualifications relating to medical insurance (e.g., classification, period of coverage)

(2) Method of provision of anonymously processed information

  1. Providing a password-protected electronic file using a DVD or other recording media by means that make it possible to confirm records of provision and receipt
  2. Providing through a server to which access is properly controlled
  3. In addition to the above, providing by means in which appropriate security measures are taken against such risks as information leakage or theft

6. Security Control Measures Concerning Retained Personal Data

The Teijin Group, including the Company, shall utilize the framework of relevant laws, regulations and guidelines to take the following security control measures for personal data, including measures to control access to personal data, restrict the means of taking out personal data, prevent unauthorized access from the outside, and prevent the leakage, loss, or damage of personal information.

(1) Formulation of basic policy

In order to ensure the proper handling of personal data as an organization, we have formulated a basic policy (see Teijin Gropup's Privacy Policy).

(2) Development of disciplines regarding the handling of personal data

We have developed handling rules regarding the method for handling personal data, a person responsible for and a person in charge of personal data, and their duties.

(3) Organizational security control measures

We shall appoint the “personal information protection manager” as the person responsible for personal information management, and clearly define the responsibilities and authority of employees with regard to the security control of personal information.

We shall supervise employees (including temporary employees), and have in place a system in which any violation of laws and handling rules, or any sign of such violation, is reported to the responsible person.

We shall establish internal rules and regulations regarding security control, ensure that our employees comply with such rules and regulations, and conduct appropriate audits of the status of compliance with them.

(4) Personnel security control measures

We shall provide employees with periodic education and training on the security control of personal information.

(5) Technical/physical security control measures

We implement the following access controls to personal data.

  • Limitation of persons with access rights
  • Acquisition, storage, and monitoring of access status
  • Periodic password changes
  • Other measures such as control of entry to/exit from rooms

We take measures to prevent theft or loss of equipment that handles personal data, or electronic media or documents containing personal data, as well as measures to ensure that personal data is not easily revealed when such equipment or electronic media are carried around, including within the office.

We have introduced a mechanism to protect information systems that handle personal data against unauthorized access from the outside or unauthorized software.

(6) Understanding the external environment

When handling personal data in a foreign country, we shall implement the necessary and appropriate measures for security control in accordance with the requirements of applicable laws, based on our understanding of the legal systems for the protection of personal information in such country.

7. Outsourcing of the Processing of Retained Personal Information

When outsourcing the processing of retained personal information, we shall conclude the necessary agreements and perform appropriate management and supervision.

8. Deletion/Erasing of Personal Information

Personal information that is no longer needed shall be deleted or erased without prior or ex-post-facto consent.

10. Authorized Personal Information Protection Organization to which the Company belongs

The Company is a member of the Federation of Pharmaceutical Manufacturers' Associations of JAPAN (FPMAJ), an authorized personal information protection organization certified by the Minister of Health, Labour and Welfare.

The FPMAJ accepts complaints and inquiries regarding the handling of personal information by its member companies.
